3. This C528 application has been filed by the applicant for setting aside the judgment and order dated 16.11.2019, passed by learned Civil Judge (J.D.), Haldwani, Nainital, in Criminal Case No.251 of 2014, Bheem Singh Vs. Chandan Singh Ginwal, under Section 138 of N.I. Act, 1881.

4. The applicant as well as the respondent are present before this Court, who are duly identified by their respective counsel.

5. A compounding application has been filed in terms of the compromise entered into between the parties.

6. Upon interaction with the respondent, he made a statement before this Court that he has entered into a compromise with the applicant of his own free will voluntarily.

7. Accordingly, the Compounding Application (I.A. No. 2 of 2026) is allowed.

8. In view of the compromise entered into between the parties, the C-528 application is allowed. Consequently, the judgment and order dated 16.11.2019 passed by the learned Civil Judge (J.D.), Haldwani, District Nainital, in Criminal Case No. 251 of 2014, Bheem Singh vs. Chandan Singh Ginwal, under Section 138 of the Negotiable Instruments Act, 1881, is hereby set aside, subject to the undertaking given in paragraph no.8 of the affidavit filed in support of the criminal miscellaneous application.

9. The applicant shall be released forthwith, if not required in any other case.

10. This order is being passed in view of the judgment of the Hon'ble Supreme Court in the case of Rajeev Khandelwal vs. State of Maharashtra and Another, reported in 2025 LiveLaw (SC) 1103.
