Mr. Rajat Mittal, learned counsel for the applicant.
2. Mr. K.S. Bora, learned Deputy A.G. along with Mr. S.C. Dumka, learned A.G.A. and Mr. Dinesh Chauhan, learned Brief Holder for the State.
3. Learned counsel for the applicant would submit that the applicant is 88% disabled, and on account of such physical disability, he is not in a position to drive a car, particularly on hilly terrain.
4. Learned State Counsel seeks time to obtain instructions in the matter.
5. In response, learned counsel for the applicant would submit that a Coordinate Bench of this Court, vide order dated 13.10.2025, had already granted time to the learned State Counsel to obtain specific instructions regarding the disability certificate of the applicant. It is further submitted that on 30.10.2025, learned State Counsel informed the Court that a report from the Chief Medical Officer, Dehradun had been received and sought time to place the same on record along with objections. However, despite the lapse of approximately four and a half months, the said report has not yet been filed by the State.
6. In the interest of justice, as a last opportunity, one week's time and no more is granted to the learned State Counsel to place on record, by way of a supplementary counter affidavit, the report of the Chief Medical Officer, Dehradun, concerning the disability of the applicant.
