Instant appeal is preferred against the
judgment and order dated 06.04.2019, passed in
Sessions Trial No. 139 of 2013, State Vs. Gyaru, by the
court of Special Judge, N.D.P.S. Act, Dehradun. By it, the
appellant has been convicted under Section 8/20 (b) (II)
(C) of the Narcotic Drugs and Psychotropic Substances
Act, 1985 and sentenced to undergo rigorous
imprisonment for a period of 20 years with a fine of Rs.1
Lakh. In default of payment of fine, to undergo simple
imprisonment for a period of three years. The appellant
seeks bail in this appeal.
2. Heard learned counsel for the parties and
perused the record.
3. This is an admitted appeal.
4. This is third bail application of the appellant.
His first bail application of the appellant was dismissed in
non prosecution on 30.09.2029. His second bail was
dismissed as withdrawn on 05.07.2024.
5. Having considered, this Court is of the view that
there is no new ground to enlarge the appellant on bail.
Accordingly, the third bail application of the appellant
deserves to be rejected.
4. The third bail application is rejected.
