4. This writ petition has been filed by the petitioner/plaintiff challenging the judgment and order dated 13.02.2017 passed by Civil Judge (J.D.) Rudrapur, District Udham Singh Nagar in Original Suit No.49 of 2016, Kanta Prasad Gangwar vs. State of Uttarakhand & others as well as the judgment and order dated 06.03.2019 passed by 3rd Additional District Judge, Rudrapur, District Udham Singh Nagar in Misc. Civil Appeal No.04 of 2017, whereby the application moved by the petitioner/plaintiff for temporary injunction has been rejected and the appeal there-against was also dismissed.
5. Learned counsel for respondent no. 3/defendant has handed over to this Court a certified copy of the order dated 16.05.2023, which is taken on record. In the said order, it is stated that the application moved by the petitioner/plaintiff under Order 23 Rule 1(3) CPC for withdrawal of the suit has been allowed.
6. In view of the subsequent development, nothing survives in the present writ petition. Accordingly, the
writ petition is dismissed as infructuous.
7. Pending application, if any, stands disposed of accordingly.
