Ms. Lubhna Jahan, learned counsel for the Revisionist.

2. Mr. Vipul Painuly, learned AGA for the State.

3. There is delay of 49 days in filing the instant revision. The grounds shown in the affidavit filed in support of the delay condonation application are sufficient to condone the delay. The delay is condoned. Accordingly, delay condonation application is allowed.

4. By means of the present criminal revision, the revisionist has put to challenge the impugned judgement and order dated 09.12.2024 passed by learned Additional Session Judge, Kotdwar, District Pauri Garhwal, in Criminal Appeal No.27 of 2023 whereby the learned appellate court confirmed the order dated 16.08.2023 passed by learned Judicial Magistrate 1st Class, Kotdwar, District Pauri Garhwal in Criminal Complaint Case No.274 of 2016. By the judgment dated 16.08.2023 revisionist was convicted under Section 138 of N.I. Act and sentenced to undergo simple imprisonment for a period of six months with a fine of Rs.2,85,000/-.

5. The matter is listed for disposal of bail application.

6. Learned counsel for the revisionist submits that revisionist was on bail during trial as well as during pendency of this appeal and he has never misuse the same; he submits that revisionist is an old person.

7. List this matter on 09.02.2026.

8. Heard on bail application.

9. Without going into the merits of the case and considering the fact and circumstances of the case, this court finds it sufficient to enlarge the revisionist on bail. Let the revisionist-Bal Krishan be released on bail on his furnishing a personal bond and two sureties of the like amount to the satisfaction of the court concerned during the pendency of this revision.
