3. This criminal revision is directed against the judgment and order dated 05.07.2025, passed by learned Ist Additional Sessions Judge, Rudrapur, Udham Singh Nagar in Criminal Appeal No.117 of 2021, Manveer Pal Vs. State of Uttarakhand and another, whereby the appeal preferred by the revisionist has been dismissed and the judgment and order dated 03.03.2021 passed by learned Additional Chief Judicial Magistrate, Rudrapur in Criminal Complaint Case No.5902 of 2017, Manish Sehgal Vs. Manveer Pal, convicting and sentencing the revisionist under Section 138 of N.I. Act, 1881, has been affirmed.

4. Revisionist was convicted and sentenced by the trial Court under Section 138 of N.I. Act, 1881 and was sentenced to undergo one year rigorous imprisonment with a fine of ₹1,65,000/- out of which, ₹1,60,000/- was to be paid to the respondent no.2-complaint by way of compensation, and in default of payment of the said amount further two months' additional rigorous imprisonment was awarded.

5. The revisionist has moved this criminal revision along with an Exemption Application (IA No.1 of 2025) for exempting him to surrender before the court after dismissal of his appeal.

6. It is contended by counsel for the revisionist in the

exemption application that the revisionist/applicant is ready to deposit a sum of ₹1,60,000/- by way of demand draft which shall be paid to respondent no.2-complainant before the court.

7. Accordingly the exemption application is allowed.

8. The revisionist shall deposit the aforesaid amount through demand draft before the Registry of this Court within two weeks from today, which shall be paid to the respondent no.2-complainant on his moving an application.

9. Admit.

10. Issue notice to respondent no.2, returnable within four weeks.

11. Steps to be taken within three days.

12. List this case on 27.08.2025.
