The appellant proposes to challenge the judgment and order dated 07/08.08.2024 in Special Sessions Trial No. 27 of 2014, State of Uttarakhand Vs. Yogendera, by the court of Special Judge, NDPS Act, Dehradun. By it, the appellant has been convicted and sentenced under Section 20 B of the Narcotic Drugs and Psychotropic Substances Act, 1985. The appeal is delayed by 227 days. A Delay Condonation Application, IA No.2 of 2025, has been filed.
In the instant case, the appellant has been provided legal assistance at State expenses. The Delay Condonation Application records that the appellant does not have any family members or close relatives, who would have assisted him in legal representation. Due to absence of parokar, the appeal on time could not be preferred.
It is not objected to by learned State Counsel.
Having considered, the Delay Condonation Application is allowed.
The delay in preferring the appeal is condoned.
