By means of the instant petition, the petitioner seeks the following reliefs:-
i. To issue a writ, order or direction in the nature of Mandamus commanding the Respondents to forthwith release the outstanding retiral benefits to the petitioner, details whereof is given herein below:-
a. Gratuity = 1062369/-(sanctioned but not paid).
b. Leave Encashment (300 days)= Rs. 643860/- (sanctioned but not paid).
c. Revised Encashment= Rs. 17640/- (sanctioned but not paid).
Total Amount = 17,23,869/-
ii. To issue any other suitable writ, order or direction which this Hon'ble Court may deem fit and proper in the circumstances of the case. iii. To award the cost of the writ petition in favour of the petitioner.
Heard.
At the very outset, learned counsel for the petitioner submits that the matter is squarely covered by the judgment dated 06.04.2022, passed by this Court in WPSS No.579 of 2022, Prem Chand Vs. State of Uttarakhand and Others.
Learned counsel for the respondent no.2 admits this fact.
Since the matter is covered, instant petition is decided in terms of the judgment dated 06.04.2022, passed by this Court in WPSS No.579 of 2022, Prem Chand Vs. State of Uttarakhand and Others.
