1. Mr. R.S. Rawat, learned counsel for the appellant.
2. Mr. V.S. Pal, learned AGA with Mr. Prabhat Kandpal, learned Brief Holder for the State/ respondents.
3. The instant appeal is filed well within time.
4. Admit.
5. Summon the trial court record.
6. Present appeal has been preferred by the appellant (convict) against the judgment and order dated 20.12.2024 passed by learned Special Judge, POCSO Act/ Addl. Session Judge, Dehradun in Special Sessions Trial No. 108 of 2018 arising out of FIR No. 179 of 2018 whereby appellant has been convicted for the offence under Section 363, 354 IPC and under Section 7/8 of the POCSO Act with maximum sentence of 3 years rigorous imprisonment. While convicting the appellant, the trial court by order dated 20.12.2024 granted interim bail to him.
7. Four weeks time is granted to the State to file objection to the bail application. Two weeks, thereafter, is granted to the appellant to file response to the objection.
8. List on 17.02.2025.
9. Interim bail granted by the trial court by order dated 20.12.2024 is extended till 17.02.2025, subject to the condition that he will not indulge in any criminal activity and if he is found to be involved in any criminal activity, interim bail granted by the trial court shall stand vacated automatically.
