Mr. M.C. Pant, Advocate, for the petitioner.

Mr. N.S. Pundir, Deputy AG, for the State.

(2) Petitioner was engaged through UPNL for discharging duties as Data Entry Operator in Industries Department. Her engagement is discontinued vide order dated 9.9.2025, which is under challenge in this writ petition. Reason assigned for discontinuing petitioner's engagement is that compassionate appointment was given to two persons, consequently petitioner was rendered surplus.

(3) Learned Counsel for the petitioner submits that petitioner is entitled to benefit of the judgment rendered in the case of Kundan Singh. (4) Learned State Counsel, on instructions, submits that petitioner was not regular in attending to her duties and her engagement was earlier also discontinued w.e.f. 2.6.2023. He submits that on petitioner's request, she was reengaged. He further submits that petitioner is not entitled to the benefit of the judgment rendered in the case of Kundan Singh. He submits that the rules of regularisation for outsourced employees have also not been framed, therefore petitioner does not have any statutory right for claiming regularisation.

(5) Mr. Neeraj Garg, learned Counsel appearing for UPNL, submits that by the impugned order, petitioner was asked to report back to UPNL so that her services may be sponsored in some other department/organisation. (6) Learned Counsel for the petitioner submits that let counter affidavit be filed so that everything may come on record.

(7) In such view of the matter, let respondents file separate counter affidavit within six weeks.

(9)       In the meantime, wages, if not

paid for any period to petitioner, may be released to her.
