1. Mr. I.P. Kohli, learned counsel for the appellant.

2. Mr. Rakshit Srivastava, learned counsel for the respondents.

3. Money withdrawal application has been moved by the claimants for withdrawing the amount towards compensation.

4. As per the office report there is delay of 44 days. The objections were invited on 29.06.2016 and the Trial Court record was also summoned and simultaneously the appellant was directed to deposit 50 percent of the total awarded amount and subject to this condition the recovery in pursuance to the impugned judgment was also stayed.

5. Delay is not opposed. Accordingly the delay condonation application is allowed and the delay is condoned.

6. Admit the appeal.

7. Now, the money withdrawal application has been moved by the claimants praying for withdrawal the amount.

8. Learned counsel Mr. I.P. Kohli submits that the appellant complied with the order and 50 percent amount has already been deposited before the Motor Accident Claim Tribunal. The money withdrawal application has been moved on the ground that the claimant is still under treatment.

9. Money withdrawal application is allowed.

10. Rs. 10 lakhs out of the deposit made pursuant to the order dated 29.06.2016 is permitted to the withdrawn by the claimants. For the purposes of withdrawal he shall move an application before the concerned Tribunal and on such application the concerned Tribunal shall release the amount forthwith.

11. List this matter for final hearing in the month of March, 2026.
