1 CLCON No. 218 of 2024
                                   Hon'ble Ravindra Maithani, J.

Mr. B.P. Nautiyal, Senior Advocate through video conferencing assisted by Mr. Mohd. Matlub, Advocate for the petitioners.

Mr. Rahul Verma, Additional Advocate General for the State.

The petitioners have brought to the notice of the Court the willful disobedience of the Court's order dated 14.09.2015, passed in Writ Petition (M/S) No. 1192 of 2015 and judgment dated 18.03.2024, passed in Special Appeal No. 574 of 2015, State of Uttarakhand and others Vs. M/s Nutech Vainish Udyog, Minikireti and others.

The response affidavit has already been filed.

The Court had required the respondent no.1 to join the proceedings through video conferencing because on the earlier occasion the Court was told that the modification application has been filed by the respondents. Filing of the modification application may not stall the proceedings of contempt.

Today, respondent no.1 has joined the proceedings through video conferencing. He submits that Special Leave Petition (Diary No.69950 of 2025) has been filed in the Hon'ble Supreme Court. He also submits that the respondents would honor the order of the Court. If the petitioners or any of them have deposited any excess stamp duty, they could produce the document to that effect and the money may be returned. He submits that, in fact, the petitioners have not deposited any excess amount. This fact is disputed by learned counsel for the petitioners.

Be it as it may, since it is stated that Special Leave Petition is preferred in the Hon'ble Supreme Court. The matter is deferred.

List on 26.02.2026.

The respondent no.1 need not appear personally, until further required by this Court.

(Ravindra Maithani, J.) 04.12.2025 Jitendra
