Mr. B.M. Pingal, learned counsel for the Revisionist.

2. Mr. G.C. Joshi, learned AGA with Mr. Rakesh Negi, learned Brief Holder for the State of Uttarakhand.

3. The present Criminal Revision is being filed against the judgment and order dated 22.08.2025, passed by learned IInd Additional Sessions Judge, Nainital in Criminal Appeal No.45 of 2022 as well as against the judgment and order dated 27.05.2022, passed by learned Additional Chief Judicial Magistrate, Nainital in Criminal Case No. 18 of 2016, "State of Uttarakhand vs. Amardeep Man and Others".

5. List this case on 26.09.2025.

6. Heard on the Bail Application (IA No. 1 of 2025).

7. It is submitted by learned counsel for the Revisionist that the Revisionist was on bail during the trial as well as during the pendency of the appeal, and he did not misuse the liberty granted to him.

8. Learned State Counsel opposed the bail application. However, he conceded that the Revisionist remained on bail during the trial as well as during the pendency of the appeal.

9. This Court is of the considered opinion that, taking into account the totality of the circumstances, the Revisionist may be enlarged on bail during the pendency of the present Revision.

10. Accordingly, the Revisionist- Gurmehar Singh Mann shall be released on bail upon executing a personal bond and furnishing two reliable sureties, each in the like amount, to the satisfaction of the Trial Court. The realization of the fine shall remain stayed during the pendency of this revision.

11. It is clarified that the grant of bail shall not be treated as a ground for seeking adjournments or for delaying the disposal of the present Revision.
