Mr. Siddharth Jain, learned counsel for the revisionist.

2. The present revision is directed against the judgment and order dated 27.05.2025 passed by learned 4th Additional Sessions Judge, Dehradun in Criminal Appeal No.194 of 2023, Ms. Neeta Chauhan vs. Shri Mahipal Singh Chauhan, under Section 29 of the Protection of Women From Domestic Violence Act, 2005 whereby the order dated 03.07.2023 passed by learned Additional Chief Judicial Magistrate, Dehradun in Criminal Complaint Case No.2329 of 2011 (Old No.622 of 2009), dismissing the complaint filed by the respondent, was set-aside.

3. It is contended by learned counsel for the revisionist that learned appellate court failed to appreciate that there is no iota of evidence on record to prove that respondent was in depression due to revisionist. Further, both sons were solely looked after by the revisionist, and the respondent never made any effort in their upbringing.

4. Issue notice to the respondent, returnable within four weeks.

5. Steps to be taken within a week.

6. List on 25.09.2025.

7. In the meantime, the execution of the judgment and order dated 27.05.2025 passed by learned 4th Additional Sessions Judge, Dehradun in Criminal Appeal No.194 of 2023, Smt. Neeta Chauhan vs. Shri Mahipal Singh Chauhan, under Section 29 of the Protection of Women From Domestic Violence Act, 2005 shall remain stayed, provided revisionist shall keep on paying Rs.15,000/- per month to the respondent on 10th of every month and shall also pay 25% of the arrears within three months from the date of passing of this order.

8. Stay application (IA No.1/2025) stands disposed of accordingly.
