Proposed Revision has been filed against the ex- parte judgment dated 04.03.2023, passed by learned Judge, Family Court, Khatima, District Udham Singh Nagar in Miscellaneous Criminal Case No. 134 of 2021, "Smt. Manisha Joshi vs. Vinod Chandra Bhatt" under Section 125 of the Code of Criminal Procedure, 1973.
2. Heard Mr. D.S. Mehta, learned counsel for the proposed revisionist and Mr. Rakesh Negi, learned Brief Holder for the State.
3. Mr. D.S. Mehta, Advocate, has requested to decide the proposed Revision granting liberty to the proposed revisionist to deposit the entire outstanding amount before the Court concerned and to file a Recall Application.
4. Proposed Criminal Revision (No. 36 of 2024) is disposed of granting liberty to the revisionist- Vinod Chandra Bhatt to deposit the entire outstanding amount before the Court concerned and to file a Recall Application, in accordance with law.
5. It is clarified that this Court has not expressed any opinion on the merit of the case.
