                            JUDGMENT

Hon'ble Ravindra Maithani, J. (Oral)

By the instant petition, the petitioner seeks

progress report in FIR No.713 of 2023, under Sections 120-B,

420, 467, 468 and 471 IPC, Police Station Gangnahar,

Roorkee, District Haridwar.

2. Heard learned counsel for the parties and

perused the record.

3. According to the FIR, the petitioner entered into

an agreement to sale with the respondent nos. 4 and 5, at the

instance of the respondent no.6. Subsequently, the sale deed

has not been executed. The FIR was lodged on 07.12.2023.

4. Learned counsel for the petitioner would submit

that the petitioner had already paid a huge amount; he has

been cheated and the land, of which the agreement was

executed, does not belong to the respondent nos. 4 and 5.

5. The FIR has already been lodged in the matter

based on the allegations that has been made by the

petitioner. The FIR has been lodged on 07.12.2023. It is just

about 1 month that the petitioner seeks progress report. It

may not be done. It is too early to speculate about the

manner, speed and any other aspect of the investigation.

Therefore, this Court is of the view that there is no reason to

make any interference, at this stage. The petition deserves to

be dismissed, at the stage of admission itself.

6. The petition is dismissed in limine.
