2. Present appeal has been preferred by the appellant against the judgment and award dated 13.01.2023 in M.A.C.P. No. 94 of 2021 passed by M.A.C.T./4th Addl. District Judge, Haridwar, whereby the said court has awarded Rs.17,50,000/- in favour of the claimant/respondents against the appellant.

3. Issue notices to the respondent nos. 1 to 6 through ordinary process and registered post acknowledgment due as well as through e-mail and whatsapp, if available.

4. Steps to be taken within a week.

5. Counsel for the appellant would submit that the Tribunal has issued the recovery certificate under Section 110 E of the Motor Vehicle Act against the appellant/Insurance Company. He would further submit that the appellant is ready to deposit the entire amount before the Tribunal concerned.

6. In view of the above, it is directed that the execution of the impugned judgment and award dated 13.01.2023 in M.A.C.P. No. 94 of 2021 passed by M.A.C.T./4th Addl. District Judge, Haridwar shall remain stayed subject to deposit of entire amount of award as directed by the Tribunal within a period of 15 days from today adjusting the statutory deposit made by the appellant. The appellant/Insurance Company shall submit the deposit receipt of the said amount before the Court within two weeks thereafter.

7. Stay application (IA No. 2 of 2023) stands disposed of accordingly.

8. List this case on 14.02.2024.

9. Urgency Application (IA 3 of 2023) stands disposed of accordingly.
