This appeal is preferred against impugned judgment and order dated 09.05.2023, passed by learned Ist Additional Sessions Judge, Roorkee, Haridwar, in Sessions Trial No.11 of 2016, in which, three persons were charged for offence punishable under Section 302 r/w 34 namely, Bholu alias Rocky, Mintu alias Madan and Tellu s/o Jaggu Singh, out of which Bholu was also charged with the offence under Section 25 of Arms Act, 1959. Out of these three persons, Bholu alias Rocky was convicted for the offence punishable under Section 302 IPC and 25 of Arms Act, while the other two persons were acquitted.

4. Against acquittal of Mintu alias Madan and Tellu s/o Jaggu Singh, son of the victim, who is also informant/complainant, has filed this appeal under Section 372 Cr.P.C.

5. As per the office report, the appeal is well within time.

6. Admit the appeal.

7. Issue notice to respondent nos. 2 and 3.

8. Steps to be taken within a week.

9. Since the L.C.R is already summoned in CRLA No. 318 of 2023, hence list this appeal along with CRLA No.318 of 2023.

10. List this case on 10.10.2023.
