Proposed Revisionist-accused Smt. Reeta Devi

was convicted and sentenced to undergo simple

imprisonment for a period of three months along with a

fine of Rs. 1,80,000/- under Section 138 of the Negotiable

Instruments Act, 1881 vide judgment dated 29.09.2022,

passed by learned Judicial Magistrate, Rishikesh, District

Dehradun in Complaint Case No.739 of 2016. Against the

said judgment, an Appeal (Criminal Appeal No.256 of

2022) was filed. The said Appeal has been dismissed vide

judgment dated 23.08.2023, passed by learned Ist

Additional Sessions Judge, Rishikesh, District Dehradun.

2. Both, learned counsel for revisionist and learned

counsel for respondent no.2 have requested to refer the

matter to the National Lok Adalat.

3. Heard on the Bail Application (IA No. 01 of

2022).

4. Mr. Amar Murti Shukla, Advocate, appearing for

the revisionist submits that the revisionist Smt. Reeta

Devi, aged about 40 years, was on bail during the trial and

appeal, and, the conditions of bail were never misused nor

violated by her.

5. Considering the facts and circumstances of the

case, this Court is inclined to grant bail to the revisionist-

Smt. Reeta Devi.

6. Let the revisionist be released on bail on her

executing a personal bond and furnishing two reliable

sureties, each in the like amount, to the satisfaction of the

Trial Court.

7. The present matter is referred to the National

Lok Adalat, which is scheduled to be held on 09.12.2023.
