3. This is an appeal under Section 374 (2) of Cr.P.C. against the judgment and conviction recorded by learned Sessions Judge, Bageshwar dated 14.09.2023 in Sessions Trial No. 7 of 2021, State Vs. Pradeep Kumar Asthana and Others, whereby the appellant was convicted under Section 3 of Uttarakhand Protection of Interests of Depositors (In financial establishments) Act, 2005 and sentenced five years rigorous imprisonment and a fine of ₹50,000/- with default stipulation of six months additional simple imprisonment.
