(2) Learned State Counsel as well as learned Counsel appearing for respondent no. 6 submits that these writ petitions are not maintainable as petitioners were appointed in primary section of a school, which was not receiving any financial aid from the State Government and they are challenging termination of their services. According to them, the only remedy available to petitioners is to approach the Tribunal constituted in terms of the judgment rendered by Hon'ble Supreme Court in T.M.A. Pai Foundation & Ors. V. State of Karnataka & Ors.
(3) Mr. M.C. Pant, learned Counsel appearing for petitioners, seeks adjournment in order to get ready on the above aspect of the matter.
(4) List on 12.5.2023. (5) It is made clear that the case
shall not be adjourned any further and shall be decided even in the absence of learned Counsel for the parties.
