Issue notice.
Mr. Vikas Pande, learned Standing Counsel for the
State of Uttarakhand, appears and accepts notice on
behalf of respondent nos. 1 to 4.
Let notice issue to respondent no. 5, returnable on
23.08.2023, by all permitted modes, including
electronically.
Counter affidavit be filed by respondent nos. 1 to 4
within four weeks.
Rejoinder before the next date.
In the meantime, we direct the respondent-
authorities to examine the grievance raised by the
petitioner, in terms of the order of this Court dated
10.08.2020, in Writ Petition (PIL) No. 112 of 2015. The
authorities shall conduct surprise checks of the respondent
no. 5-Mosque at least on 10 occasions at different times of
the day, and record the decibel level and the sound
emanating from the respondent no. 5-Mosque. The findings of the said surprise checks shall be placed on
record, along with the counter affidavit.
In case, it is found that there is breach of the
judgment of this Court dated 10.08.2020, in Writ Petition
(PIL) No. 112 of 2015, the respondents shall proceed to
take action in accordance with law in the meantime,
without waiting for any further orders from this Court.
