Mr. Siddhartha Sah, learned counsel for the appellant.
Mr. Davesh Bishnoi, learned counsel for the caveator.
The solitary argument raised by the learned counsel for the appellant in support of the delay condonation application is that as against the judgment of the Appellate Court, he has filed a review which later on stood decided. Hence, the Second Appeal was filed thereafter.
The said prayer has been opposed by the learned counsel for the respondent, on the ground, that even the review of the judgment passed by the Appellate Court, was said to have been filed at a much belated stage only on 06.10.2023.
Learned counsel for the appellant prays for and is granted two days' time to place on record the relevant authority in support of his contention to the effect that even the period, which was consumed in filing the review application till its decision could be taken as to be the basis for condonation application.
