The instant revision is preferred against judgement and order dated 15.02.2023, passed in Misc. Criminal Case No.63/2019, Smt. Rachana Sharma and Another Vs. Dr. Brij Kishore Sharma, by the court of Family Judge, District Udham Singh Nagar, by which maintenance has been denied to the revisionist No.1 on the ground that she has been staying separate without sufficient cause. Rs. 4,000/- maintenance has been awarded to the revisionist No.2.
Heard.
It is the case of the revisionist that the impugned judgment and order is not in accordance with law; the amount of maintenance, which has been awarded to the revisionist No.2 is inadequate, keeping in view the income of the respondent.
The impugned order notes that the monthly salary of the respondent is Rs. 57,346/-. The court in the impugned order has recorded the statements of the witnesses to conclude that the revisionist No.1 is staying separate without any reasonable cause.
Having considered, this Court is of the view that this matter definitely requires deliberations.
Admit.
Issue notice to the respondent returnable within four weeks.
