In this C482 Application the prayer which is being made for quashing the order dated 07.06.2023 as it was passed by the Court of learned Additional District and Sessions Judge, Dehradun in SST No.10 of 2021, "State Vs. Imran @ Tota", which has been carried against the present accused person for the commission of offence under Section 363, 366-A, 376 and 506 of the IPC and Section 5/6 of the POCSO Act.
Based upon, almost the similar set of circumstances and that too for the orders passed under Section 319 of the Cr.P.C., one of the accused has approached this Court by filing C482 Application No.1308 of 2023. The said C482 Application was dismissed by an order dated 06.07.2023.
Learned counsel for the applicant submits that since law and facts in the present C482 Application happens almost to be identical to that of C482 Application No.1308 of 2023, the present C482 Application would too stands decided in terms of the judgment rendered in C482 Application No.1308 of 2023 as decided on 06.07.2023.
