Hon'ble Alok Kumar Verma,J.

Learned Trial Court convicted the revisionist-

accused of the charges of Sections 323, 504 and 506 of the

Indian Penal Code, 1860 (in short, "IPC") and sentenced him

to undergo simple imprisonment for a period of six-six

months in each offence. He was further convicted and

sentenced to undergo rigorous imprisonment for a period of

two years along with a fine of Rs. 1,000/- for the offence

punishable under Section 392 IPC. All the sentences were

directed to run concurrently.

2. Against the said judgment dated 01.08.2022,

passed by learned Trial Court, a Criminal Appeal (No. 63 of

2022) was filed. The said Appeal has been dismissed vide

judgment dated 30.05.2023, passed by learned Sessions

Judge, Pithoragarh.

3. Heard Mr. Syed Nadim, learned counsel for the

revisionist and Mrs. Manisha Rana Singh, learned A.G.A. for

the State.

4. Admit.

5. List on 20.10.2023.

6. Heard on the Bail Application (IA No. 1 of 2023).

7. Learned counsel for the revisionist has submitted

that there are certain material contradictions in the

statements of the prosecution witnesses. Revisionist was on

bail during the trial and appeal and the conditions of bail

were neither misused nor violated by him.

8. The bail application has not been seriously

opposed by the respondent.

9. Considering the facts and circumstances of the

case, this Court is inclined to grant bail to the revisionist,

namely, Deepak Kumar.

10. Let the revisionist be released on bail on his

executing personal bond and furnishing two reliable sureties,

each in the like amount, to the satisfaction of Trial Court.
