The present C482 Application emanates from a summoning order dated 10.08.2022, as it has been passed in Criminal Case No. 1260 of 2022, State Vs. Sanjay Kumar and others. The challenge is also being given to the Chargesheet No. 272 of 2020 dated 28.07.2020, whereby the present applicant has been summoned by the Court, for being tried for the offences under Section 323, 498A and 504 of IPC and Section 3/4 of the Dowry Prohibition Act.
Looking to the FIR, the contents of the Chargesheet and the nature of the summoning order, since the dispute happens to be a matrimonial dispute, it will be apt, that the matter may be disposed of in terms of the judgment of Satender Kumar Antil Vs. Central Bureau of Investigation and another, as reported in 2021 (10) SCC
If the applicants surrender before the Court concerned and seek their bails in the light of the parameters laid down in 'A' category of offences, as classified in the aforesaid judgment of Satender Kumar Antil (supra), their bail applications would be considered in accordance with para 3 (e) of the said judgment.
Accordingly, C482 Application stands disposed of.
