Stay Vacation Application (IA/2/2022)
By this application, applicant mother seeks vacation of the order dated 23.5.2022, passed by this Court staying the operation of the impugned judgment dated 5.5.2022, passed by the Judge, Family Court, Haridwar, whereby the custody of the minor son of the parties was directed to be handed over to the respondent's mother.
The appellant is present in Court. We have interacted with him.
Presently, the mother is not having any visitation rights with the child and this position is continuing since three years. In these circumstances, as a first step, it is essential that the mother starts interaction with the child on a regular basis. The child is residing at Dehradun, whereas the respondent is at Roorkee.
We direct that the respondent would be entitled to meet the child every weekend. The child shall be picked up by the respondent from school on every Saturday and collected back by the appellant on the following Sunday at 5 PM from the residence of the respondent at Roorkee.
List on 3.4.2023.
On the next date, the parties and the child shall remain present in the Court for interaction.
