Admit the revision.

Summon the lower court record. The counsel for the revisionist presses the bail application filed in support of the criminal revision on the ground that the alleged conviction of the present revisionist by the concurrent judgments rendered in Criminal Case No.9929 of 2013, State vs. Jane Alam, as well as that of the judgment dated 06.01.2023 as rendered in Criminal Appeal No.67 of 2015 Jane Alam vs. State of Uttarakhand, are contrary to the observation, which has been made in the judgment of conviction because of the fact, that he has been only roped up for the commission of the offence because of certain documentary evidences, which were said to have been found in the offending vehicle. He further submits that during the course of trial he was on bail.

Apart from that considering the sentence, which has been imposed upon the present revisionist for his alleged commission of the offence under Section 279 as well as 304-A IPC, the revisionist is directed to be released on bail subject to furnishing of his personal bound and two sureties of the like amount to the satisfaction of the Magistrate concerned.

However, the release of the applicant would be subject to the condition of depositing of penalty amount as imposed against him, as against each of the offences.

Registry is directed to prepare the paper book after receipt of the records of the court below.

Bail Appl. No.01 of 2023 as well as Urgency Appl. No.02 of 2023 stand disposed of accordingly.
