The petitioner is in custody, hence he could not appear in the Court today.
The petitioner has filed this writ petition for quashing of the F.I.R. dated 10.11.2022, registered as case FIR No. 0303 of 2022, under Sections 323 and 376 of I.P.C. at P.S. Khatima, District Udham Singh Nagar in terms of compromise arrived at between the parties.
However, it is borne out from the record that he has executed Authorization in favour of his father, who is present in the Court today.
Learned Deputy Advocate General for the State shall take instructions in the matter and the learned counsel for the petitioner and learned counsel for the private respondent shall apprise the Court about the desirability of compromise and quashing of the F.I.R. on that basis, in view of the judgment pronounced by the Hon'ble Supreme Court in the case of "Gian Singh vs. State of Punjab (2012) 10 SCC 303" and "State of M.P. vs. Laxmi Narayan (2019) 5 SCC 688".
List this matter on 09.01.2023 as fresh.
