Proposed Second Appeal has been filed against the judgment dated 16.09.2022, passed by the learned IIIrd Additional District Judge, Udham Singh Nagar in Civil Appeal No.23 of 2020, "Sanjeev Kumar Saraswat and Another vs. Rajeev Kumar Saraswat", whereby, the judgment and decree passed by the learned Trial Court has been set aside and the suit for perpetual injunction, filed by the respondents - plaintiffs, has been decreed. Hence, the present Second Appeal.

Heard Mr. Atul Kumar Bansal and Mr. Bhagwat Singh Negi, learned counsel for the proposed appellant.

In the facts and circumstances of this case, it would be appropriate to issue notice to the respondents - plaintiffs even before passing any order on the Admission.
