Mr. I.P. Kohli, counsel for the appellant.
2. There is delay of 01 days in filing the appeal
3. Perusal of the delay condonation application (IA 1 of 2019) would reveal that the causes mentioned in the affidavit in support of delay condonation application are that the delay was caused due to procedural reasons for taking the legal opinion and permission from Regional Office to file the appeal.
4. The delay has not been seriously opposed by the counsel for the respondents.
5. In view of the above, the delay condonation application is allowed. Delay is condoned.
6. Heard on stay application (IA 1 of 2023).
7. Considering the submission made by counsel for the appellant, it is directed that the execution of the impugned judgment and award dated 07.02.2023 passed by M.A.C.T./Additional District Judge, Almora in M.A.C. NO. 07 of 2021 shall remain stayed subject to deposit of 50% amount of the entire awarded amount before the tribunal concerned adjusting the statutory deposit made by the appellant.
8. Stay application (IA 2 of 2023) stands disposed of according.
