3. This is a criminal appeal filed under Section 374 (2) of Cr.P.C. under conviction recorded by learned Ist Additional District and Sessions Judge, Nainital in Sessions Trial No.5 of 2019. By the impugned judgment dated 28.07.2023, appellant was convicted for the offences punishable under Sections 302 IPC and was sentenced for life imprisonment and fine of `5,000/- with default stipulation of six months additional simple imprisonment, under Section 324 IPC and was sentenced for two years rigorous imprisonment and a fine of `2,000/- with default stipulation of three months additional simple imprisonment, under Section 147 IPC and was sentenced for one year rigorous imprisonment and a fine of `1,000/- with default stipulation of one month additional simple imprisonment. All sentences were directed to run concurrently.

7. Since L.C.R. is summoned in the connected appeal, therefore, there is no need to summon the L.C.R. in this appeal.
