The instant C482 application has been preferred by the applicant putting a challenge to the proceedings of the Criminal Case No.305 of 2021, "State Vs. Salimuddin @ Riyaz", whereby they have been summoned by an order dated 17.08.2021, for being tried for the offences under sections 420, 120B and 34 of IPC.
Learned counsel for the applicant before venturing to address the C482 application on its own merit, has confined his prayer that this C482 application may be disposed of in the light of the judgment of "Satender Kumar Antil Vs. Central Bureau of Investigation and another" as reported in 2022 (10) SCC 51.
In view of the aforesaid candid statement made by the learned counsel for the applicant, the C482 application would stand disposed of leaving it open for the applicant to surrender before the court of Judicial Magistrate, Jaspur, District Udham Singh Nagar, and seek his bail, in accordance with the guidelines framed by the Hon'ble Apex Court, for the purposes of dealing with the "A" category of the offences, as classified by the judgment of "Satender Kumar Antil Vs. Central Bureau of Investigation and another" as reported in 2022 (10) SCC 51.
Subject to the aforesaid, the C482 application would stand disposed of.
