The present applicant is facing proceedings of Criminal Case No.955 of 2021, "State Vs. Jeesram" being the proceeding which has been drawn against him for the offence under Section 406 of the IPC, which is pending consideration before the Court of Judicial Magistrate, Vikasnagar, District-Dehradun.
Learned counsel for the applicant instead of arguing the C482 Application on merits, has opted out to voluntarily resort to the avenue available to him in the light of the judgment of Satender Kumar Antil Vs. Central Bureau of Investigation, as reported in 2022 (10) SCC
In view of the aforesaid statement of the learned counsel for the applicant, this C482 Application would stand disposed of leaving it open for the applicant to surrender before the Court of Judicial Magistrate, Vikasnagar, District Dehradun and resort to remedies, as provided by the judgment of the Hon'ble Apex Court in the matter of Satender Kumar Antil (Supra).
Subject to the aforesaid exception, the C482 Application stands disposed of.
