3. Heard learned counsel for the parties.
4. The petitioner has prayed for a writ of mandamus commanding the respondents to reinstate the petitioner on the post of Collection Amin with consequential benefits and with arrears of payment of salary with admissible interest as per law.
5. Learned counsel for the petitioner submits that a first information report was lodged against the petitioner in the year 2003 and after investigation, the charge-sheet was submitted against him and a Criminal Case No.334 of 2012, State vs. Om Prakash Badhani under Sections 409 & 420 IPC was in trial before the court of Chief Judicial Magistrate Tehri Garhwal. He also submits that petitioner was placed under suspension owing to the fact that the first information was lodged against him and today, the writ petition has been filed on the ground that in the aforesaid trial, the petitioner was acquitted of the charges vide judgment and order dated 17.09.2015, passed by learned Chief Judicial Magistrate, Tehri Garhwal, therefore,
petitioner prays for reinstatement with all consequential benefits as stated hereinabove.
6. Let instructions be called by learned State Counsel from the Department as to whether petitioner is still in service or not.
7. List this matter on 08.08.2023 after fresh cases.
