Mr. Rakesh Kunwar, learned Additional C.S.C. for the State of Uttarakhand.
Petitioner was appointed as Teacher in Government Primary School in the year 2005. His services were, however, terminated on the ground that his B.Ed. degree was found to be forged. The termination order was set aside by this Court in WPSS No. 1214 of 2020 vide judgment dated 18.05.222 on the ground that provisions contained in Uttarakhand Government Servants (Discipline and Appeal) Rules, 2003 were not followed. After the judgment of this Court, petitioner is being treated to have been put under suspension.
In this writ petition, petitioner has staked claim for subsistence allowance.
Since petitioner has prayed for writ of mandamus, for which he has also made a formal demand before respondent no 3, therefore, writ petition is disposed of by directing respondent no. 3 to take decision on petitioner's representation dated 13.09.2022 (annexure no. 7 to the writ petition), within four months from the date of presentation of certified copy of this order.
