The proposed Second Appeal has been filed against the judgment and decree dated 29.11.2021, passed by the learned IInd Additional District Judge, Kashipur, District Udham Singh Nagar in Civil Appeal No. 80 of 2019, "Ahmad Hussain vs. Mohd. Juber alias Jubair Hussain (deceased) through legal representatives", whereby, the appeal has been dismissed.

The said appeal was filed against the judgment and decree dated 04.12.2019, by which, the trial Court had passed the final decree in the partition suit.

Heard Mr. Deepak Kandpal, the learned counsel for the proposed appellant.

Having heard the learned counsel for the proposed appellant, it would be appropriate to summon the original record even before passing any order on the admission.
