Mr. J.S. Virk, learned Deputy Advocate General for the State/appellant and Mr. Shubhr Rastogi, learned counsel for the respondent.
The delay of 177 days' in preferring the appeal has been explained properly by the State.
Prime facie, the judgment passed by the learned Sessions Judge appears to be perverse and unreasonable, because at one hand, he has held the appellant to be a minor i.e. below the age of 18, but, on the other hand, he has held that she is a consenting party. Hence, the Application for Condonation of Delay (CRMA No.4216 of 2020) is allowed and the delay of 177 days' in preferring the appeal is condoned.
Since the respondent have already appeared, there is no need to issue any warrant.
Call for scanned copies (both hard and soft) of trial court records.
After receipt of the TCRs, paper book be prepared and copy of the same be supplied to the learned counsel for the parties.
List the matter for final disposal on 13.06.2023.
