Mr. H.M. Raturi, learned Deputy Advocate General for the State of Uttarakhand.
Petitioner's father was an employee of Education Department serving as Lecturer (Mathematics), who died while in service on 23.02.2017. In view of precarious financial condition of the family, petitioner applied for compassionate appointment on 12.07.2019, however, his application has not been considered so far. Thus, feeling aggrieved, petitioner has filed this writ petition seeking a direction to the Competent Authority to appoint him under Dying in Harness Rules.
Mr. T.P.S. Takuli, learned counsel appearing for petitioner has placed reliance upon a judgment dated 15.04.2019 rendered by this Court in WPSS No. 534 of 2009 and he submits that since identical question has been decided in the said writ petition, therefore, present writ petition may also be decided in the same terms.
Accordingly, writ petition is disposed of in terms of judgment dated 15.04.2019 passed in WPSS No. 534 of 2009 and the Competent Authority is directed to consider petitioner's request for compassionate appointment, as per law, within ten weeks from the date of production of certified copy of this order.
