Upon hearing the learned Counsel, the Court made the following
JUDGMENT : (per Sri S.K. Mishra, A.C.J.)
After the order was passed by this Court on
29.12.2021, police protection was granted to the
petitioners.
2. It is submitted by Mr. Avidit Noliyal, the
learned counsel for the petitioners, that in the meantime,
an FIR has been registered against the private
respondent, but he does not have any instructions.
3. In that view of the matter, the Writ Petition is
disposed of by directing the Senior Superintendent of
Police, District Haridwar, to reexamine the matter, and to
take a decision whether it is necessary to continue
providing police protection to the petitioners, after taking
intelligence from the S.H.O. concerned within 21 days.
However, it is made clear that the disposal of this Writ
Petition shall not be given any negative weightage.
4. In sequel thereto, all pending applications also
stand disposed of.
5. Urgent certified copy of this order be issued to
the parties, as per Rules.
6. A free copy of this order shall be provided to
the learned Deputy Advocate General for the State
Government for onward communication and early
compliance.
