CRLR/327/2022
2022 Latest Caselaw 1897 UK

Citation : 2022 Latest Caselaw 1897 UK
Judgement Date : 29 June, 2022

Uttarakhand High Court
CRLR/327/2022 on 29 June, 2022
CRLR No. 327 of 2022
Hon'bleRavindraMaithani, J.

Mr. Vipul Sharma, Advocate for the revisionist.

Mr. Lalit Miglani, A.G.A. with Ms. Sonika Khulbe, Brief Holder for the State.

Mr. Parikshit Saini, Advocate for respondent no.2.

In the case, private respondent has already been represented.

It is a revision challenging an interim order of maintenance. What is being argued is that, in fact, the wife concealed information with regard to her financial resources in an affidavit, which was filed pursuant to the judgment in the case of Rajnesh vs. Neha and Another (2021) 2 SCC 324.

The Court wanted to know from the learned counsel for the revisionist as to whether this point was raised in the court below?

Yesterday, there was not reply. In fact, it was told that it was the duty of the court to examine the affidavit.

Today, learned counsel for the revisionist would submit that, in fact, by way of an application the deficiencies and concealments in the affidavits were brought to the notice of the Court. He seeks time to file that application.

Let respondent no.2 may also file objection to the revision.

Meanwhile, the revisionist may also file application or other document that may help this Court to decide the controversy.

List this matter on 19.07.2022.
