Shri Sanjaya Kumar Mishra, J.
Mr. Lokendra Dobhal, learned counsel for the petitioner.
Ms. Manisha Rana Singh, learned A.G.A. for the State of Uttarakhand.
Mr. Pratul Kumar, learned counsel for the respondent nos. 3 & 4.
The petitioner - Madheshwar Prasad @ Madhu is present, who is accused in this case and respondent nos. 3 and 4 - Arvind Singh Bhakuni and Vikram Thapa are also present respectively.
This writ petition has been filed by the petitioner for quashing the FIR dated 23.08.2021 being FIR No. 190 of 2021 registered under Sections 420, 467, 468, 471 and 120-B of I.P.C by the respondent no. 3 at P.S. Dalanwala, District - Dehradun.
Parties are present, in person, before this Court and they are duly identified by their respective counsel.
I have also inspected their Aadhar Cards. Xerox Copies of Adhar Cards duly signed by the parties and counter signed by their respective counsel are taken on record.
This case does not fall under category of cases excepted by the Hon'ble Supreme Court in the two judgments i.e. Gian Singh v. State of Punjab (2012) 10 SCC 303 and State of Madhya Pradesh v. Laxmi Narayan (2019) 5 SCC 688 for compromise, therefore, there is no impediment in allowing the compromise application.
Since the parties have entered into compromise, no useful purpose would be served to continue with the investigation and direct for the trial of the case.
Accordingly, the writ petition and compounding application no. 2 of 2022 are allowed. FIR dated 23.08.2021 No. 190 of 2021 registered under Sections 420, 467, 468, 471 and 120-B of I.P.C at P.S. Dalanwala, District - Dehradun against the petitioner is hereby quashed.
Urgent certified copy of this order be supplied to the learned counsel for the parties, as per Rules.
