This Revision is emanating from the judgment of 27th July, 2017, as it was rendered by the Judge Small Causes Court/2nd Additional District Judge, Dehradun, in SCC Suit No. 5 of 2014, Smt. Preetam Kaur Banga Vs. Avinash Pandey.
The matter remained pending, though the respondent was served with the notices on the Delay Condonation Application, by way of publication.
But, when the matter was taken up today. Apart from the fact that the counsel for the revisionist has made a statement at the Bar, that as per the instructions received by her from the revisionist, since the revisionist has vacated the tenement, in question, no lis as such stands survived now to be decided.
Apart from it, this Court has received the information from the Registrar (Judicial) that the SCC Suit No. 5 of 2014, which was pending before the Trial Court, has been adjudicated and decreed by the judgement dated 27.07.2017.
In view of the above statement made by the learned counsel for the revisionist, the present Civil Revision, for all practical purposes, have been rendered infructuous.
The same is accordingly dismissed as having rendered infructuous.
