JUDGMENT
Hon'ble Ravindra Maithani, J. (Oral)
In this petition, a question is raised that
despite Court's order in Sessions Trial No.118 of 2019,
State vs. Ujjwal Sharma @ Jassi and others, under
Sections 302, 396, 376-D, 457, 323, 504, 506, 412, 120-
B and 34 IPC, pending in the court of Fast Track Special
Court/Additional Sessions Judge, Dehradun, the
witnesses are not being examined by the prosecution.
2. Today, under instructions, learned State
counsel would give a statement that in this matter four
witnesses have already been examined and PW5, the
victim was to be examined on 22.02.2022. Out of the
witnesses examined, PW1 is the informant, PW2 is also
one of the witnesses named in the FIR.
3. Now, statement is given that PW5 has been
examined yesterday. The Court has not given any
direction, as to within which period the witnesses were to
be examined.
4. It is the case pertaining to sexual assault and
murder. This Court has no doubt that the court below
shall take all endeavours to decide this case, as
expeditiously as possible.
5. With the above observations, the petition
stands disposed of.
