These two connected C-482 applications were allowed by the Coordinate Bench by the judgment of 11.08.2021, whereby the directions were issued to consider the case of the petitioner for release of his aforementioned mobiles, which was the case property, but despite of the judgment of 11.08.2021, the directions given therein have not been complied with even though the Judicial Officer, who is seized with the proceedings, has filed an application for extension of time on 25.09.2021 and thereafter on 22.11.2022.

Owing to the reasons, which have been given therein, though this Court is not satisfied with the reasons given, as the matter has been kept pending, however an adjudication has been directed ever since 11.10.2021. Hence, directing the Additional Chief Judicial Magistrate to decide the aforesaid case as directed by the Coordinate Bench judgment of 11.08.2021 within a period of six weeks from today, it is made clear that no further extension would be granted on an administrative application filed by the Judicial Officer. If the proceedings are not concluded within the aforesaid extended time period, the Court would be constraint to issue a Judicial notice of the aforesaid fact.

Accordingly, MCRC No.4 of 2022 respectively filed in the two connected C-482 Applications by the Additional Chief Judicial Magistrate, Kashipur, District Udham Singh Nagar would stand disposed of.
