The criminal appeal has been preferred against the judgment of conviction dated 30.09.2020, as it has been rendered in Special Sessions Trial No. 32 of 2018 "State Vs. Naveen", whereby, the appellant has been convicted for the offences under Sections 363, 366- A, 376(2)(n) of the Protection of Children from Sexual Offences Act, 2012.
There is 183 days' delay in filing the present criminal appeal.
Delay condonation application (IA 1 of 2022), under Section 5 of the Limitation Act, has been filed by the learned counsel for the appellant seeking condonation of delay.
The said application is not being opposed by the learned Government Advocate.
Couple with the fact, the reasons given therein, since seems to be satisfactory. Hence, the delay of 183 days, which has chanced in filing the criminal appeal, would stand condoned.
The delay condonation application is allowed.
With the consent of the learned counsel for the parties, the appeal is heard on admission.
Admit the appeal.
Summon the lower court record. List this criminal appeal after receipt of the lower court record for consideration of the bail application.
Meanwhile, the learned Government Advocate may file objections to the bail application.
