Miscellaneous Application I.A. No. 1 of 2022 This is an application moved by the respondent to seek monthly maintenance to the extent of Rs.50,000/- per month from the date of filing of present appeal against the judgment and order dated 16.09.2021 passed by the learned Judge, Family Court, Haridwar dismissing the divorce petition preferred by the appellant-husband under Section 13(1)(ia) of the Hindu Marriage Act in O.S. No.22 of 2021.
The Family Court had granted maintenance @ Rs.20,000/- per month to the respondent - wife during pendency of the divorce petition.
Since none appears today to argue the matter on behalf of the respondent, we direct the appellant to pay to the respondent maintenance @Rs.20,000/- per month (twenty thousand only) from the date of filing of the present appeal till further orders. The arrears be cleared within four weeks, however, the monthly
payment of maintenance @Rs.20,000/- per month should be made punctually for the current period. The appellant shall also pay litigation expense to the tune of Rs.20,000/- to the respondent within one month. The monthly maintenance be paid by the tenth of every month in advance.
