Mr. Rakesh Thapliyal, learned Assistant Solicitor General for the Union of India.
Mr. D.S. Patni, learned Senior Counsel assisted by Mr. Dharmendra Barthwal and Mr. Vipul Sharma, learned counsels for respondent nos.5 and 6.
In response to the affidavit filed by the Director,
Geology and Mining, Government of Uttarakhand, to
state that the stone crusher, in question, falls in the
plain area, Mr. D.S. Patni, learned Senior Counsel
appearing for respondent nos.5 and 6, states that
there is no basis for the said claim. It is not disclosed
as to on what parameters it is claimed that the stone
crusher in question falls in the plain area. He has
drawn our attention to Page Nos.978 to 980, wherein
the said respondents have raised their objections to
the said claim with regard to the stone crusher falling
in plain area.
Mr. Dushyant Mainali, learned counsel for the
petitioner, submits that the said respondents have
never challenged the policy of the Government and the
classification of the area as the plain area.
Arguments heard.
Judgment reserved.
