The submission of the learned counsel for the petitioner is that when the petitioner was considered by the Assessment Promotion Committee on 05.12.2011 for Assessment Promotion to Scientist 'F', and he was not promoted, that was third chance of assessment.
He submits that the petitioner's case was considered for fourth time by the Promotion Committee Meeting held on 22.11.2012 which was due w.e.f. 01.04.2010. On this occasion, he was recommended for promotion to the next Scientist 'F'. However, the promotion was granted in fact w.e.f. 22.11.2012 when the Assessment took place and not w.e.f. 01.04.2010. He placed reliance on the judgment of this Court in Dr. N.K. Saini and Others Vs. Union of India and Others in WPSB No.349 of 2015 connected with another petition.
